Terms and Conditions

Agreement

1. By engaging the Service Provider, the Client agrees to these Terms and Conditions.

Definitions

1. Service Provider refers to Imaginative Pte Ltd, offering media production services
2. Client refers to the individual, company, or entity purchasing and/or receiving the paid or sponsored services.
3. Content refers to the photos, videos, RAW, working and any other media produced by the Service Provider.

Scope of Services

1. The Service Provider agrees to provide photography and/or videography services as outlined in the signed agreement or proposal or booking page(s).
2. Specific details of the services, including date, location, and deliverables, will be documented in writing.

Fees and Payment Terms for Paid service

1. The Client agrees to pay the booking fees to book this service agreement.
2. A non-refundable deposit of 50% of production fee is required to confirm the booking, with the balance due 7 days after the event or project completion, unless otherwise stated in writing.

Fees and Payment Terms for Sponsored service

1. The Client agrees to pay the booking fees to book this service agreement.
2. A non-refundable payment of $50 is required to confirm the booking.

Revisions and Changes

1. The Client is entitled to 2 rounds of revisions to the final deliverables, unless otherwise stated in writing.
2. Additional revisions or changes will be charged at the rate of $150 per hour, unless otherwise stated in writing.
3. Any changes to the project scope must be agreed upon in writing and may result in additional fees.

Intellectual Property

1. The Service Provider retains copyright ownership of all content unless otherwise agreed in writing.
2. The Client receives a non-exclusive, non-transferable license to use the content for the purposes outlined in the signed proposal, agreement or in writing.
3. Unauthorised use, reproduction, or distribution of the content is prohibited and may result in additional fee.

Liability

1. The Service Provider will not be liable for any delays or non-performance resulting from circumstances beyond their control, such as natural disasters, equipment failure or motor accidents.
2. The Service Provider’s liability for any claims related to the services shall not exceed the amount paid by the Client.

Cancellation and Rescheduling

1. The Client may cancel or reschedule the services with written notice at least 48 hours prior to the agreed date.
2. Cancellation within 24 hours will result in forfeiture of the deposit.
3. In the event of cancellation by the Service Provider, a full refund of any payments will be provided.

Confidentiality and Privacy

1. The Service Provider agrees to maintain the confidentiality of any sensitive information shared by the Client.
2. The Client consents to the use of content for the Service Provider’s portfolio, marketing, or promotional purposes unless otherwise specified in writing.

Delivery of Content

1. Final deliverables will be provided within 3 week of the event or completion of the project, unless otherwise stated in relevant proposal(s), agreement(s) or booking page(s).
2. Delivery will be made via Google Drive or WeTransfer.
3. The Client is responsible for backing up the deliverables upon receipt.

Governing Law

1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore.
